If You're Denied

A negative decision is not always the end of the road. Read the reasons and act promptly.

The right next step depends on the kind of decision, the issue in dispute, the evidence available and the options described in your decision letter. Time limits can apply, so do not delay in getting advice.

Read the reasons first

Identify what VAC decided, what evidence it relied on, what evidence it says is missing and which part of the decision you disagree with. Use the decision-letter worksheet to organize your questions.

Match the remedy to the issue

Some matters may be addressed by asking VAC to reconsider or review a decision; others may require an application to the Veterans Review and Appeal Board.

Get help early

A Legion service officer, Bureau of Pensions Advocates lawyer or another qualified representative may help explain options and deadlines.

Do not assume the deadline

Use the time limit in your decision letter and verify it with the relevant official body. Do not rely on general information from a website.

Keep in mind: This guide is general information, not legal advice. Verify current requirements, available procedures and deadlines with VAC, VRAB or a qualified representative.
